By accessing or using Postiz Social Media (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.

Postiz Social Media is a web application that allows users to connect their TikTok account using TikTok's official Login Kit and to publish original video content to their TikTok profile using TikTok's official Content Posting API.
The Service is operated by Antoine LANDRY, based in 97419, France. The Service is provided as a technical tool for user-initiated publishing actions. We act as a facilitator and do not publish, moderate, or take responsibility for the content users choose to submit.
3. Eligibility and Account Requirements
To use the Service, you must:
- Be at least 16 years old, or the minimum age required in your country to consent to online services;
- Have a valid TikTok account in good standing;
- Have the legal capacity to enter into a binding agreement under the laws of your jurisdiction;
- Not be barred from using the Service under applicable law.
You are responsible for maintaining the security of your account credentials and for all activity performed under your account. You must not share access credentials with unauthorized parties.
4. User Responsibilities
By using the Service, you agree to:
- Use the Service only for lawful purposes and in accordance with these Terms;
- Publish only content that you own or that you are fully authorized to publish;
- Comply with TikTok's Terms of Service and Community Guidelines at all times;
- Comply with all applicable laws, including copyright, trademark, and intellectual property law;

You retain full ownership of the content you publish through the Service. By submitting content for publication, you represent and warrant that:
- You are the original creator of the content, or you hold all necessary rights, licenses, and authorizations to publish it;
- The content does not infringe any copyright, trademark, trade secret, or other intellectual property right of any third party;
- You have obtained all required consents from any individuals who appear in or are identifiable from the content;
- The content complies with all applicable laws and with TikTok's platform rules and Community Guidelines.
We do not claim any ownership over the content you publish. We act solely as a technical intermediary for your user-initiated publishing actions.
6. Prohibited Uses
You must not use the Service to:
- Publish content you do not own or are not explicitly authorized to publish;
- Infringe the intellectual property rights, privacy rights, or other rights of any third party;
- Post illegal, fraudulent, defamatory, harassing, threatening, or misleading content;
- Upload or transmit malicious code, viruses, spyware, or any harmful software;
- Attempt to circumvent any security measure, access control, or authentication mechanism;
- Scrape, crawl, or use automated tools to access the Service in ways not expressly permitted;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Engage in bulk, automated, or bot-driven publishing not based on direct human user action;
- Use the Service for any commercial purpose not expressly permitted under these Terms;
- Violate TikTok's Terms of Service, Community Guidelines, or any other applicable platform rules.
7. No Unauthorized Reposting
This Service is strictly intended for publishing content that users own or are explicitly authorized to publish. Reposting, redistributing, or republishing content originally created by other users or third parties without proper rights, licenses, or explicit authorization is strictly prohibited.
Any use of the Service to republish copyrighted material, content created by third parties, or content to which the user does not hold the necessary rights may result in immediate suspension of access and may expose you to legal liability.
8. Compliance with Third-Party Platform Rules
Your use of the Service is subject to TikTok's Terms of Service and Community Guidelines, which are separate from and in addition to these Terms. You are responsible for remaining familiar with those rules and complying with them.
We reserve the right to suspend or restrict your access to the Service if we determine, in our reasonable judgment, that your use violates TikTok's platform rules or the rules of any other applicable third-party service.
9. Service Availability

10. Suspension and Termination
We reserve the right to suspend, restrict, or permanently terminate your access to the Service at any time, without prior notice, if:

- Your use of the Service violates applicable law or third-party platform rules;
- We determine that your account or published content poses a risk to other users, third parties, or the integrity of the Service;
- We are required to do so by applicable law, regulation, or lawful authority.
Upon termination, your right to access or use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including without limitation those relating to intellectual property, warranties, liability, and indemnification) will remain in full effect.

All elements of the Service, including but not limited to its design, source code, user interface, branding, and associated materials (excluding user-submitted content), are the intellectual property of Antoine LANDRY or are used under license. All rights are reserved.
You may not reproduce, copy, modify, distribute, publicly display, create derivative works from, or commercially exploit any part of the Service without our express prior written permission.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available", without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
We do not warrant that the Service will be error-free, secure, or free from interruption. Your use of the Service is entirely at your own risk.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Antoine LANDRY, its affiliates, and respective officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Service — including but not limited to loss of data, loss of profits, or reputational harm — even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amounts paid by you, if any, for access to the Service during the twelve (12) months preceding the event giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Antoine LANDRY, its affiliates, and their respective officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of or access to the Service;
- The content you publish or attempt to publish through the Service;
- Your breach of any provision of these Terms;
- Your violation of any applicable law or the rights of any third party.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of France.
16. Changes to the Terms
We may update these Terms from time to time to reflect changes in the Service, applicable law, or our practices. When we do, we will revise the effective date at the top of this page.
Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service. If changes are material, we will make reasonable efforts to notify registered users in advance.
